SUBJECT: Formal Complaint Regarding Executive Conflicts of Interest, Lack of Administrative Transparency, and Breaches of Public Accountability
 
Background Statement
 
Public trust relies entirely on transparency, accountability, and the equal application of the law. As a resident active in the community, numerous neighbors and citizens frequently come to me to share information regarding local administrative concerns. While I generally prefer to remain out of civic disputes, the pattern of events detailed below represents a severe systemic risk to our city's legal position, the integrity of our executive leadership, and the safety of our neighborhoods. These matters must be formally entered into the city's official record and investigated.
 
The community has recently become fully aware of two major administrative shifts that were handled with complete secrecy: the out-of-state job application of City Manager Michael Hart in Siloam Springs, Arkansas, and his personal relationship with our now-former City Attorney. This complaint focuses directly on the failure of the executive branch to transparently manage these conflicts, as well as a severe, unrelated public safety incident involving local law enforcement evasion.
 
Part 1: Executive Search Transparency
The Issue: The public has verified that the City Manager was named a top-three finalist for an out-of-state City Administrator position. Hiding executive job searches prevents the City Council from planning for leadership continuity and managing public resources effectively.
 
Formal Request for Inquiry: What is the established municipal protocol for notifying the full City Council and the public when top appointed charter executives are actively seeking employment elsewhere? What steps are being taken to ensure leadership stability now that this search has been exposed?
 
Part 2: Undisclosed Conflict of Interest & Timeline Evasion
The Issue: An intimate relationship between the City Manager (who was in a relationship) and the chief legal counsel creates an immediate conflict of interest that compromises the independent legal defense of La Junta.
 
The Timeline Breach: Specific timeline details have been brought forward by individuals demanding accountability who rightfully fear administrative retaliation. This timeline establishes that from May 1st through May 10th, the City Attorney confirmed frequent, ongoing meetups with the City Manager. However, a selective disclosure was only made on May 11th—exclusively to the Mayor's office, deliberately keeping the full City Council and the public completely in the dark.
 
Formal Request for Inquiry:
If these frequent meetings over that ten-day period were strictly professional, why was the substance of those urgent discussions hidden from the full City Council, denying them their oversight role?
 
If those meetings were personal, why was a severe, actionable legal conflict of interest actively concealed from the governing body before a forced disclosure was made? The community demands an honest, public explanation for the true structural reasons behind the sudden resignation of our chief legal counsel.
 
Part 3: Administrative Retaliation & Sidelining
The Issue: Effective municipal governance requires that all elected council members have an equal seat at the table.
 
Formal Request for Inquiry: Why does it appear that council members who push back on resource allocation or demand accountability—specifically Council Member Maureen Rikhof—face systematic exclusion from key meetings, updates, and administrative processes?  
 
Part 4: Public Safety Breach & Law Enforcement Evasion
The Issue: Multiple neighbors and anonymous party attendees have reported a highly concerning incident where City Manager Michael hosted a party at his residence and repeatedly launched mortar shell fireworks, entirely disregarding his neighbors and municipal codes.
 
The Incident: When a neighbor approached to request that the fireworks stop, the request was disregarded, and Michael proceeded to light another mortar shell. When the neighbor returned a second time to request compliance, a party attendee at Michael's house physically punched the neighbor.
 
Evasion of Law Enforcement: When local law enforcement officers arrived at the scene to investigate this physical assault, only a single individual from the party answered the door.
 
Meanwhile, City Manager Michael and Mayor Joe Ayala, along with the remaining partygoers, refused to step forward, staying inside the home to avoid interacting with responding officers.
 
Formal Request for Inquiry: How can the citizens of La Junta trust our executive leadership when the City Manager and the Mayor choose to remain inside a house to avoid interacting with the very law enforcement officers funded by the citizens of this town? What disciplinary actions or independent investigations are being initiated to address this flagrant disregard for neighbors, public safety, and law enforcement response?
 
Conclusion & Demand for Action
 
The citizens of La Junta deserve a government where conflicts are disclosed immediately, timelines are accurate, and our highest-ranking officials are held to the exact same laws as every other resident in this community.
 
I request that Council Member Rikhof formally enter this complaint into the public record at the next scheduled city council meeting and utilize her position to demand a formal, independent investigation into the timeline of the City Attorney's resignation, the potential use of administrative retaliation against dissenting council members, and the police call logs regarding the executive misconduct on the night of the assault.
